Conveyancing; More Than a Necessary Evil

When it comes time to buy or sell a home, many see conveyancing services as a necessary evil however choosing the right conveyancer can save thousands and provide extra protection during the settlement process.


Maureen Moffat of Strand Conveyancing Services Western Australia believes that many home buyers and sellers underestimate the importance of conveyancing and don’t understand the services and protection they provide.


“Conveyancing services have been perceived by most as a necessary evil – deaths, taxes and conveyancing fees – however most buyers and sellers don’t grasp the value and security that they provide,” Ms Moffat said.


“The legalities involved in the process of buying or selling a property requires a specialist service to ensure unnecessary fees and legal headaches are avoided,” Ms Moffat continued.


As well as avoiding unnecessary fees and legal complications, conveyancers are responsible for keeping up to date on the latest changes to state and federal legislation affecting property transactions.


The Office of State Revenue, for example, recently introduced amendments to the Duties Act 2008 altering the transaction time allowance that duty is payable. All transactions are now to be lodged within two months from execution of any contract regardless of the contract being conditional or not. Failure to recognise such transactional changes increases the chance of unnecessary penalty interest being charged.


The importance of conveyancing services was highlighted recently in Western Australia when a lack of proper procedure led to a local Karrinyup man’s house being sold out from under him due to misrepresentation.
